MYCHART TERMS OF USE

This MyChart Terms of Use is an agreement between you and, if applicable, any individual who has given you their proxy to access their MyChart account on their behalf (“You”) and [The New York and Presbyterian Hospital] [Cornell University for Weill Cornell Medicine] [The Trustees of Columbia University in the City of New York for Columbia University Irving Medical Center] (the “Institution”). TO USE MYCHART, YOU MUST ACCEPT THE TERMS AND CONDITIONS SET FORTH IN THIS TERMS OF USE AND AGREE TO BE BOUND BY THE INSTITUTION’S NOTICE OF PRIVACY PRACTICES WHICH IS HEREBY INCORPORATED INTO THESE TERMS OF USE BY CLICKING "I ACCEPT" BELOW. IF YOU DO NOT AGREE TO THE TERMS OF USE, YOU WILL NOT BE ABLE TO USE MYCHART. The Institution participates in an Organized Health Care Arrangement (OHCA) among The New York and Presbyterian Hospital, Cornell University for Weill Cornell Medicine, The Trustees of Columbia University in the City of New York for Columbia University Irving Medical Center and their related entities. This allows these institutions to share health information to carry out treatment, payment and joint health care operations relating to the OHCA, including integrated information system management, health information exchange, financial and billing services, insurance, quality improvement, and risk management activities.

USE OF PROTECTED HEALTH INFORMATION

When you use MyChart to store or retrieve personal and medical information, all of the data is stored in your personal account. All personal and medical information you enter into MyChart is governed by these terms and conditions and any other contained or referenced in this MyChart site, including the Institution’s Notice of Privacy Practices which can be found here. When you provide personal and medical information through MyChart, you authorize the Institution to use and distribute it in connection with MyChart.

As part of MyChart, you may authorize your participating providers to provide personal information about you. You may use MyChart to share certain personal information with such providers. You may use MyChart to communicate with such providers. You understand that any decision to use MyChart in such ways is entirely voluntary. You understand that if you authorize a provider to access your personal information in MyChart and communicate with you via MyChart that provider may permit its/his/her staff and other authorized users within its/his/her facility or office to use MyChart to access your personal information and communicate with you as well.

The Institution may enable you to integrate your MyChart record with third-party personal health records. In order to use a specific available service, you must inform the Institution that you would like to allow the third-party service provider to retrieve, provide, and/or modify information in your MyChart account. Once you authorize a specific third-party service provider to access your MyChart account, such provider may continue to access your account until you affirmatively disable access. Third-party service providers may include both providers and other entities. In addition, you may enable a provider to have access to your MyChart record on a one-time, temporary basis through Share Everywhere; such access requires the provider be given a “share code” generated by you in MyChart. You are solely responsible for reviewing and approving each such third-party before sharing your information through MyChart or otherwise allowing them to access it. If you elect to use any service the Institution adds to or enables within MyChart, such election constitutes your authorization and consent to sharing your personal information with all authorized third-parties.

CONTENT USAGE

The Institution uses this website (MyChart) as well as their other websites and branded social media sites to provide general information about health care topics. The contents of these sites, such as text, videos, graphics, images, quoted information and all other materials (“Content”) are provided for reference only and may not be complete, up to date or exhaustive or applicable to any particular individual’s medical condition. Content is not medical advice and is not to be used or relied on for diagnosis or treatment. Content is for informational purposes only and does not take the place of diagnosis, instructions or advice from your doctor or health care providers and may not necessarily take into account your individual health situation. Talk to your doctor or other health care providers before making a health care decision. Reliance on any Content is solely at your risk. Users are warned to follow the advice of their physicians without delay regardless of anything read in this Health Library. The Institution assumes no duty to correct or update the Content nor to resolve or clarify any inconsistent information which may be a part of the Content. Reliance on any Content is solely at the User's risk. Publication of information or reference in MyChart to specific sources such as specific products, procedures, physicians, treatments, or diagnoses are for information only and are not endorsements by the Institution.

When using MyChart, you may sometimes be offered links to third party websites not managed by the Institution. The Institution is not responsible for and has not verified the information or materials contained on any third party web sites, or on web sites that provide links to MyChart and You should not rely on any of the information found on these websites for purposes of diagnosis or treatment. Links from MyChart are provided for informational purposes and for your convenience only and are not intended as an endorsement by the Institution of the organization or individual operating the third party website or application or a warranty of any type regarding either the third party website or application, or the information on the third party web site or application. The Institution shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content, products or services available on or through such third party websites or applications.

ELIGIBILITY AND PROXY ACCESS

Any adult age 18 or over is eligible for a MyChart account. Parents or guardians of minor children newborn to day before 12th birthday inclusive, may request proxy access to their child's account by following the terms below. Minor children between the ages of 12 and 18th birthday inclusive will be eligible to participate in MyChart. Children in this age range will have the same access as adult eligibility.

Adult patients may grant proxy access to their MyChart account to other adults age 18 and over, by completing a Proxy Access Consent Form. This Adult to Adult Proxy access does not expire, and shall remain active until the proxy access is revoked by either the adult patient from within their MyChart account, or by the patient notifying the Institution and requesting the proxy access be revoked. The Institution reserves the right to revoke proxy access at any time for any reason, unless otherwise required by law.

Parents or guardians of minor children, newborn to day before 12th birthday inclusive, may request proxy access to the child's MyChart account. Such access will only be granted to parties with parental rights or legal guardianship over the MyChart account holder. A MyChart account will be activated for both the proxy and the child patient. The proxy will access the child's health information through the proxy account. If the proxy's legal relationship with the account holder changes, the proxy must inform the Institution immediately by contacting the provider. Due to limitations currently imposed by State and Federal law, when a minor patient reaches age 12, their MyChart account shall be deactivated, along with all proxy access to the account and access to the account must be created by the minor.

Parents or guardians of children age 12 to 18th birthday inclusive may only be granted proxy access to the child's MyChart account by the child signing a Proxy Access Consent Form. Proxy access consent will need to be renewed every two years. Proxy access will be restricted to comply with the limitations currently imposed by State and Federal law. Proxy access will be terminated when the child reaches 18 years of age.

The Institution reserves the right to revoke proxy access at any time for any reason.

MEDICAL DISCLAIMER

Communications with healthcare providers through MyChart are not in "real-time", and should not be used for urgent or emergency situations. The Institution will make its best effort to provide a timely response to electronic inquiries. In some cases, the clinical staff that needs to respond to an electronic inquiry or other communication may not be immediately available so a patient should allow at least two (2) business days for a response. Accordingly, situations requiring immediate attention should not be submitted electronically. Furthermore, with respect to any electronic communications sent by the patient, the Institution is only able to respond to such communications based on the information provided by the patient. If there is insufficient information provided, the Institution will be unable to provide an accurate and reliable response. Response time of MyChart may be longer than normal if service is interrupted for maintenance, upgrades, or emergency repairs related to events beyond Institution’s control. In this respect, you agree not to hold the Institution, its affiliated practices, providers or any of its staff, in any way liable or responsible to you for such modification, suspension or disruption of MyChart.

MyChart does not provide any medical services, including emergency or urgent medical services. PLEASE CALL 911 OR YOUR HEALTH CARE PROVIDER IF YOU BELIEVE THAT YOU ARE EXPERIENCING A MEDICAL EMERGENCY OR IF YOU NEED URGENT CARE.

The Institutions are not responsible for the accuracy, timeliness, completeness or Your or any medical professional’s reliance on Your personal information contained in or accessed through MyChart unless such information is posted by the Institution, contained in your medical record, or imported by you and validated by your doctor or other health care provider.

DISCLAIMER OF WARRANTY

THE INSTITUTION PROVIDES MYCHART "AS IS" WITH ALL FAULTS AND MAKE NO WARRANTIES OR GUARANTEES OF ANY KIND, AND EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES OF ANY KIND OR NATURE, WHETHER EXPRESS, IMPLIED, OR STATUTORY REGARDING MYCHART, INCLUDING BUT NOT LIMITED TO THE ACCURACY, COMPLETENESS, CORRECTNESS, AVAILABILITY, SECURITY, TIMELINESS OR USEFULNESS OF ANY INFORMATION, PROGRAMS, PRODUCTS, OR SERVICES, OR OTHER MATERIAL PROVIDED THROUGH MYCHART, OR OF RELIABILITY, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

LIMITATION OF LIABILITY

IN NO EVENT WILL THE INSTITUTON OR ITS AFFILIATES, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, VOLUNTEERS, SPONSORS AND AGENTS BE LIABLE TO YOU, ANYONE CLAIMING BY THROUGH OR UNDER YOU, OR ANYONE ELSE FOR (i) ANY DECISION OR ACTION TAKEN, OR NOT TAKEN, IN RELIANCE UPON THE INFORMATION CONTAINED OR PROVIDED THROUGH MYCHART, (ii) CLAIMS ARISING OUT OF OR RELATED TO MYCHART, (iii) YOUR USE OF MYCHART, (iv) USE OR DISCLOSURE OF YOUR PERSONAL OR MEDICAL INFORMATION OR (v) FOR ANY DAMAGES OF ANY KIND UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH USE OF, OR INABILITY TO USE, MYCHART, INCLUDING ANY DIRECT, INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, WRONGFUL DEATH, DAMAGES RESULTING FROM DELAY, INTERRUPTION IN SERVICE, VIRUSES, DELETION OF FILES OR ELECTRONIC COMMUNICATIONS, OR ERRORS, OMISSIONS OR OTHER INACCURACIES IN SERVICE, POSSIBLE HEALTH SIDE EFFECTS, OR FINANCIAL LOSS, EVEN IF THE INSTITUTION KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES, CLAIMS, DEMANDS OR ACTIONS. THE INSTITUTION SHALL NOT BE HELD LIABLE UNDER THIS AGREEMENT FOR MORE THAN $1,000. The foregoing limitation and exclusion of liability shall be as broad and inclusive as is permitted by the state in which you live.

TERMINATION

The Institution may place limits on, modify, suspend or terminate all or any portion of MyChart at any time without prior notice. Additionally, notwithstanding the rights you may have to the personal information and/or data in your MyChart record, if any, the Institution may cancel your account and delete all data associated with your account at any time, and without notice, for any reason. The connection to your provider may be modified, suspended, or terminated by your provider at any time and without notice, however, you will still have access to your MyChart account. In addition, except with respect to a proxy who establishes an account on behalf of a minor child or other individual as described herein, the Institution will terminate your account following notification of your death. Accordingly, you are solely responsible for maintaining your own copies of any data or personal information maintained within MyChart or of any communications received through MyChart. The Institution assumes no liability for any information removed from MyChart. The Institution also has the right to maintain and/or destroy all data associated with your account in accordance with its then current document retention and destruction policies. Upon any termination of your access to MyChart, you must cease all use of MyChart.

GOVERNING LAW

MyChart may only be accessed from the United States of America.

This Agreement, and any claim, controversy or dispute arising under or related to this Agreement, the relationship of the parties and/or the interpretation and enforcement of their respective rights and obligations, shall be governed by and construed in accordance with the laws of the State of New York, without regard to principles of conflicts of law. The parties hereto agree to the exclusive jurisdiction of the courts located in the State of New York and the exclusive venue of New York County.

These Terms of Use may be amended by the Institution at any time without notice by posting the amended Terms of Use to the MyChart web site and providing a notice on the website that the Terms of Use has changed. Upon Your next use of MyChart, you will be asked to accept these changes by clicking “I Accept” which shall be deemed acceptance of the new Terms of Use. If you do not so agree to the Terms of Use as amended, you shall stop using MyChart and the Institution shall cancel your account. You agree that this User Agreement sets forth the entire understanding between you and the Institution. You further agree that if any portion of this User Agreement is held invalid, the balance shall continue in full force and effect.
